Please read these Terms of Service carefully before using TradeAlert.Pro. By accessing or using our service, you agree to be bound by these terms.

1. Acceptance of Terms

By creating an account, accessing, or using TradeAlert.Pro ("Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Description of Service

TradeAlert.Pro provides a webhook-to-phone call notification service for trading alerts from TradingView. Key features include:

• Receiving TradingView webhooks
• Converting webhooks to instant phone calls
• SMS backup notifications (optional)
• Call history and analytics
• Webhook URL management

3. Eligibility

You must:

• Be at least 18 years old
• Have the legal capacity to enter into binding agreements
• Provide accurate registration information
• Maintain the security of your account credentials

4. Account Registration and Security

Account Creation

• You must provide a valid email address and create a secure password
• You must verify your phone number to receive alerts
• One account per user - multiple accounts are prohibited
• Business/enterprise accounts must contact us for proper setup

Account Security

• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• Keep your webhook URL private - anyone with it can trigger calls to your phone
• Notify us immediately of any unauthorized access or security breach

5. Acceptable Use Policy

You May

• Use the Service for legitimate trading alert notifications
• Connect TradingView webhooks to receive alerts
• Receive phone calls and SMS notifications
• Manage your subscription and settings

You May Not

• Use the Service for spam, harassment, or illegal activities
• Share your webhook URL publicly or with unauthorized parties
• Attempt to bypass rate limits or usage restrictions
• Reverse engineer, decompile, or hack the Service
• Use automated tools to abuse the Service
• Resell or redistribute the Service without authorization
• Send excessive or abusive webhook requests
• Violate any applicable laws or regulations

6. Subscription Plans and Billing

Free Plan

• 3 calls per month
• No credit card required
• All core features included
• May be modified or discontinued at any time

Premium Plan

• $8 per month (or as displayed on pricing page)
• Unlimited calls
• Billed monthly via Stripe
• Auto-renews unless cancelled

Billing Terms

• Subscriptions auto-renew on the billing anniversary
• You authorize us to charge your payment method automatically
• Price changes will be communicated 30 days in advance
• No refunds for partial months of service
• Overdue accounts may be suspended

Cancellation

• Cancel anytime from your dashboard
• Access continues until end of billing period
• Automatically downgrade to Free Plan after cancellation
• No refunds for unused time

Refund Policy

• 14-day money-back guarantee on first Premium subscription
• Contact support within 14 days for refund
• Refunds processed within 5-10 business days
• Abuse of refund policy may result in account termination

7. Service Level and Limitations

Uptime

We strive for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be announced in advance when possible.

Rate Limits

• Free Plan: 1 call per minute burst limit
• Premium Plan: 10 calls per minute burst limit
• TradingView webhook limits: 60/minute, 500/hour (imposed by TradingView)

Delivery Times

We target sub-2 second delivery from webhook to phone call. Actual delivery times may vary based on:

• Phone carrier network conditions
• Signal strength and location
• TradingView webhook delays
• Internet connectivity

Limitations of Liability

IMPORTANT: TradeAlert.Pro is a notification service only. We are not responsible for:

• Trading decisions made based on alerts
• Financial losses from missed or delayed alerts
• Inaccurate alert messages from TradingView
• Phone carrier delivery failures
• Service outages or interruptions

8. Intellectual Property

Our Rights

• TradeAlert.Pro name, logo, and branding are our property
• Service code, design, and features are protected by copyright
• You may not copy, modify, or create derivative works

Your Content

• You retain ownership of alert messages sent through webhooks
• You grant us license to process and deliver your messages
• We may store call history for up to 90 days

9. Prohibited Uses

You may not use TradeAlert.Pro to:

• Send spam, phishing, or malicious content
• Harass, threaten, or abuse others
• Violate any laws or regulations
• Infringe on intellectual property rights
• Transmit viruses, malware, or harmful code
• Attempt unauthorized access to our systems
• Interfere with the Service or other users

10. Termination

By You

• Delete your account anytime from dashboard settings
• All data will be permanently deleted within 30 days

By Us

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Use the Service fraudulently or illegally
• Fail to pay for Premium subscription
• Abuse or misuse the Service
• Pose a security risk

We will provide notice when possible, but reserve the right to terminate immediately for serious violations.

11. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy. Key points:

• We collect email, phone number, and usage data
• We use Twilio for call delivery and Stripe for payments
• We do not sell your personal information
• You can request data deletion at any time

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability
• Uninterrupted or error-free operation

WE DO NOT WARRANT THAT THE SERVICE WILL BE AVAILABLE AT ANY PARTICULAR TIME OR FROM ANY PARTICULAR LOCATION.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRADEALERT.PRO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Loss of profits, revenue, data, or business opportunities
• Trading losses resulting from missed or delayed alerts
• Service interruptions or data loss
• Third-party actions (TradingView, Twilio, phone carriers)

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR $100, WHICHEVER IS LESS.

14. Indemnification

You agree to indemnify and hold harmless TradeAlert.Pro from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any laws or third-party rights
• Content you submit through webhooks

15. Dispute Resolution

Informal Resolution

Before filing a claim, please contact us at support@tradealert.pro to attempt informal resolution. We'll work in good faith to resolve disputes.

Arbitration Agreement

Any disputes not resolved informally shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. You waive the right to participate in class action lawsuits.

Governing Law

These Terms shall be governed by the laws of the State of Delaware, USA, without regard to conflict of law provisions.

16. Third-Party Services

Our Service integrates with:

• TradingView: You must comply with their Terms of Service
• Twilio: Phone call delivery service
• Stripe: Payment processing

We are not responsible for third-party service outages, changes, or terminations. Review their respective terms and privacy policies.

17. DMCA and Copyright

If you believe content on our Service infringes your copyright, contact us with:

• Description of the copyrighted work
• Location of the infringing material
• Your contact information
• Good faith statement
• Statement of accuracy and authorization

18. General Provisions

Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and TradeAlert.Pro.

Severability

If any provision is found unenforceable, the remaining provisions shall remain in full force.

No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.

Assignment

You may not assign these Terms. We may assign our rights and obligations without restriction.

Force Majeure

We are not liable for failures caused by events beyond our reasonable control (natural disasters, wars, pandemics, internet outages, third-party service failures).
